This is to inform that there is an annoucement for the Thailand Labour Protection Act (no.7) with effective 5th May 2019.
- The amount of statutory severance pay for an employee who has worked for at least 20 years has been increased to 400 days at the employee’s last wage rate (from 300 days) with following chart:
- Employers must grant pregnant employees 98 days’ maternity leave, which includes leave taken for pre-natal exams before the delivery date, and holidays that fall during the maternity leave period. The employer must pay up to 45 days’ wages during maternity leave.
- Employees are entitled to take up to three paid days per year for personal business leave. They can take more than three such days but they will not be paid.
Remark : The Department of Labour Protection and Welfare may issue a ruling to determine what sort of leave is considered ‘business leave’. - Where the employer terminates the employment of an employee, the employer shall pay wage, overtime pay, holiday pay, holiday overtime pay and money the employer shall pay under this Act to an employee who is entitled to receive such pay, within three days from the date of termination of the employment
- Change of employer, or merger and/or acquisition between the employer and another party that results in any employee becoming an employee of a new employer will require the employee’s consent and the new employer must assume all existing rights and obligations of the previous employer. This could include all cases of transfer of employment, merger and acquisition, and amalgamation.
